Same judge whose psychosis rulings vacated one mother's murder conviction hung the jury on another's.
“One judge, one psychosis theory, two mothers — and it lands in opposite places depending on which one's sitting in front of him. That's not a legal standard, that's a coin he flips after the trial's already over. And they want you to trust the same guy holds the scale steady next time a jury hangs.”
“You can't compare these, they're totally different juries, totally different records — a hung jury isn't a vacated conviction, that's apples and oranges. Sullivan gave Clancy's jury the dynamite charge because he respects due process, and he vacated Sanders's conviction because the psychosis evidence there was compelling. Did I just say the same evidence works both ways? That's not — forget I said that.”
