The muscle didn't wait around for the parts to get used. On September 14th, the EPA gutted the emission limits on the coal and gas plants that produce roughly a quarter of the country's climate pollution — the same tool, a third swing, no court in the way yet. Three days after that, on the 17th, the Natural Resources Defense Council, the American Lung Association, and four other groups filed suit over the rollback in federal court, adding a case to a pile that already has two rulings sitting on top of it.

The pilot's job is the landing, and this landing is one day old: an EV mandate erased Saturday using the identical procedural shortcut two courts found illegal earlier this same month, unappealed, unused for this one, sitting exactly where the rulings left it. The tool has been proven twice. Nobody on this file has picked it up yet.
