2026 is already the deadliest year for measles in the United States since the virus was declared eliminated in 2000. Four people died over the last month in Pennsylvania amid an ongoing outbreak in the state, which had not seen a measles-related death in at least 35 years. All four victims, including two infants, were unvaccinated…

THE COUNT
Appeals court to decide fate of rollback signed by the secretary who doubted the deaths were real

As it ran on the front
On August 28th the health secretary looked at Pennsylvania's measles count and asked, in public, whether the two deaths the state had reported were even real. That's the file. I went back and checked it against what came after, because that's the job, hon.
Eighteen days later, on September 15th, Pennsylvania reported two more deaths, a teenager among them, bringing the total to four — the most measles deaths the country had seen in a single year since 1992, and the first measles death the state had recorded in at least 35 years. The secretary's question about two deaths now sat next to a fourth.…
…(cont) On September 23rd a pediatrician who has spent his career on the disease said out loud what the dashboard already showed: 2026 is the deadliest measles year in the United States since the disease was declared eliminated in 2000. Both infant deaths counted by then were children too young for their first dose, which isn't given before the age of one.
The outbreak kept its own calendar. September 28th: 903 cases, 115 new in a week. September 30th: a fifth death, a Lancaster County resident, unvaccinated, no further details released by the department. The secretary had asked in August whether two deaths were real. By the end of September the state had buried five.
Monday's dashboard turned over again. The new total is 1,004 cases, the largest outbreak the commonwealth has recorded in more than three decades, with 198 hospitalizations sitting under the same five deaths. Measles does not file a budget request. It runs the numbers the way numbers run, and the gap between what the secretary doubted in August and what the department has since confirmed is now three deaths wide.
Hochul's order landed that same Monday: a statewide disaster emergency, not over a death count but a case count, 108, in New York's own under-vaccinated rural counties, expanding which healthcare professionals are allowed to give the MMR shot. A tenth of Pennsylvania's number, answered this early, which is its own kind of arithmetic.
On Tuesday, a federal appeals panel heard arguments in the medical groups' lawsuit over the vaccine-access rule the secretary rolled back — the rule he moved on only after he had already stood up in August and asked whether the deaths behind it were real. The court will decide the rollback's fate. The five Pennsylvania families are not named parties to that case. But they are in the file, and the file is dated, and the dates only run one direction.
“He didn't lose the argument about those two deaths, he just let the state's own dashboard argue it for him, five times over. Pennsylvania crossed a thousand cases and buried a fifth person before the rule he rolled back even got a hearing, and New York had to declare a state of emergency just to get its own nurses permission to give the same shot without the extra paperwork. That's not a policy debate, that's a stopwatch, and somebody else's kid is the one it's timing.”
“Look, the Secretary was simply asking rigorous questions about the data — that's good governance, that's due diligence, and frankly if two deaths can't withstand a little scrutiny maybe they — okay, I hear how that sounds. The access rule wasn't rolled back, it was modernized for parental choice, and the fact that two states had to declare emergencies to work around it is really a testament to federalism functioning exactly as designed. Did I say the emergencies prove the system's working? That's not what I meant, let me circle back on that one.”
