California's wildfire accountability bill dies in Sacramento, resurfaces as a lawsuit against homeowners' own insurer.

The call comes in this week as an orange map and a heat warning running from Sunday through Thursday, record highs stacked on top of fires already loose in the hills. The New York Post's survey of the state's current blazes puts the two trends on top of each other: the hottest stretch of the year landing exactly when the fires are already moving.
One month earlier, the tool built for this exact collision got set down instead of used. On September 1, California Democrats declined, at the last hour, to advance the bill holding wildfire-starting utility companies accountable — the Post's own phrase for the maneuver is an "11th hour reprieve," granted to the companies whose equipment starts the fires, not to the people standing under them. The bill did not lose on the facts reported here. It simply stopped moving, and a utility's liability for a spark stayed exactly where it was the day before the vote.…
…(cont) One day earlier, Monday, August 31, Los Angeles County had already filed its own hundred-page document on the other half of the same fire season. The county's lawsuit accuses State Farm, the state's largest homeowner insurer, of systematically mishandling claims from the 2025 fires — claims some residents are still waiting on, nearly two years out. The county did not wait for Sacramento to decide whether a utility answers for ignition. It went straight at the company deciding, line by line, what a burned house is worth.
A homeowner reading both documents this week does not get to pick which tool survived the season. They get the one left on the table: depose the adjuster who worked the 2025 file, and hope the heat wave running through Thursday does not hand that same adjuster a second one to lowball before the first lawsuit is even finished.

That's not an accident, that's the design: make the outfit that caused the damage immune, and make the outfit that's supposed to cover the damage the only name left on the lawsuit. Either way the family whose house burned pays twice — once in smoke, once in premiums.”
