Election spending watchdog can't open a single case, weeks before the most expensive vote in history.

The Federal Election Commission's ability to enforce the nation's campaign finance law died this week in Washington. It was 51 years old, born in 1975 out of the Watergate hearings, built with six seats and one rule: four of them had to be filled before the agency could act on anything at all — open a case, levy a fine, answer a complaint. As of this week's count, two commissioners remain and four seats sit empty. It takes four to work. That arithmetic is not malarkey; it is the whole obituary in one sentence.

It leaves behind a crowded field. Four days later, on the 28th, the federal government's own cyber-defense agency laid out its plan for Election Day itself — guarding the machines, the count, the wires that carry the result home.…

…(cont) Neither of those is the Commission's job, and it is worth saying plainly so the eulogy does not borrow a jurisdiction it never had. The Commission never watched the voter rolls. It never watched the machines. It watched the money: who gave it, who took it, whether anyone lied about either.

The money is not waiting for a quorum. What is projected to be the most expensive election cycle on record is arriving on schedule, cycle after cycle having gotten only more expensive, and the one federal agency built to ask where that money came from cannot currently open the file to ask. A chair left empty long enough stops being furniture and becomes a sentence finished by other people's business. Two commissioners can show up to work. They cannot rule on anything once they get there.

In lieu of flowers, the family asks that the four empty seats be filled before the money already in motion finishes moving.

“They always tell you there's no money to watch where the money goes, and look, there's a watchdog, it's just missing its teeth right when the checks get fattest. Two people can't hold a quorum any more than two people can hold an election honest, and that's the whole scam: let the refs walk off the field right before the biggest game anybody's ever played.”
