Christa Pike received two doses of pentobarbital on September 30. She was not dead by Wednesday night, and by Thursday Governor Bill Lee was calling it "deeply disturbing" and suspending every execution in the state through the end of the year. By Friday her lawyers described her as unconscious and intubated, in critical condition. By Saturday the state's own file caught up with it: Frank Strada, the man running Tennessee's prisons, had five botched executions on his record across two states since 2022 — four of them in Arizona, on the books before Tennessee hired him anyway. …(cont) On Monday night Pike's lawyers were told she was brain dead and life support would be removed. On Tuesday she woke up and started talking.
By Wednesday she was in front of a judge, through counsel, "angry and confused," unable to move her arms. Her lawyers said she remains shackled to the hospital bed. Medical staff asked the Tennessee Department of Correction to take the restraints off; the department said no. Her lawyers amended their motion and asked the judge for that relief instead.
The judge, for his part, ordered the state to preserve everything — the drugs, the syringes, the equipment — while the case continues. Pike's attorneys are now asking to inspect the syringes directly. All together now: the state that tried to kill her twice is being asked to hand over the hardware so a court can find out why it didn't work.
In Texas, a man named Jamaal Howard was scheduled to die Wednesday at 7 p.m. His lawyers cited Pike's case in their own filing to stop it.
And legal scholars, reading all of this, pulled a 1947 Supreme Court decision off the shelf — the one that asks what a state owes a person who survives its own attempt to execute them.
Tennessee suspended its executions through the end of the year. The commissioner who ran five of them is gone. The syringes are preserved as evidence instead of discarded. None of that required a new law. It required someone to ask a judge, politely, to preserve the file.
“They hired a guy with four botched executions already on his sheet, let him run a fifth, and the only thing getting protected right now is the evidence, not the woman. That's not an accident, that's an agency covering its own ass with a court order instead of a trash bag. Next time they tell you the system has checks and balances, ask who checked Strada's file before they handed him the keys.”
“Look, the governor acted fast — suspended every execution in the state, ordered an independent inquiry, that's accountability working exactly like it's supposed to. Sure, Strada had — did I say four prior botched executions? I mean, every state corrections system has had incidents, that's not unique to Tennessee. The point is the process is working: a judge ordered the evidence preserved, that's transparency, that's the system — okay, the system also includes a woman shackled to a hospital bed who woke up unable to move her arms, but procedurally, this is fine.”
