As it ran on the front
The understanding that the Justice Department does not raid a sitting member of Congress's home inside an election's final sixty days died Monday in Washington. It carried no statute number and had no settled age; it was only ever a custom, the penny-ante sort that goes unwritten because the people enforcing it agreed, without saying so, not to test it. Now it has been tested, and there is nothing left to point to except the Monday it broke.
The dying took weeks. In September, border czar Tom Homan told Fox News there was a "criminal" investigation involving Rep. Ilhan Omar and that "things are going on," declining to say what. Days later Omar told cameras that DHS had not actually contacted her about it — a denial that did not age well once it became clear the agency she said had gone quiet was the one Homan had just been speaking for. By late September the Washington Examiner was running the old rumor that Omar married her own brother for immigration purposes, framed as a revived federal interest; a former federal prosecutor weighed in on air to note the "very high bars" required to prove marriage fraud, the kind of caveat that exists for claims built not to clear them.…
…(cont) None of that turned out to be Monday's warrant. Fox News and the New York Post report the actual question under investigation: whether Omar was older than seventeen — not the minor the filing made her — when that paperwork went through. The theory is older than most of her constituents. The sixty-day clock on acting on it is new, and it just ran out.
The New York Times filed the driest sentence of the day, noting the search fell inside the window the department has historically avoided for investigative steps touching political candidates. Historically is a word reserved for practices that used to hold. The shit of it is that a custom with no text to cite survives for exactly as long as the people enforcing it feel like citing it, and this week they stopped.
Born: at no fixed date, the way most customs are. Preceded in death by: Homan's boast that he knew things were going on, and Omar's denial that anyone had told her so.
In lieu of flowers, ask your own representative, whichever party, what happens to the other fifty-nine days.

“They spent a month telling Fox News there's a 'criminal' file on her before they ever picked up the phone to call her, and the day they finally move, it's not a subpoena, it's a search team at her front door sixty days before people vote. That's not law enforcement, that's a message sent to any member of Congress thinking about saying the wrong thing out loud in an election year. The paperwork's from 2000 — they had twenty-six years to ask nicely.”
“This is a judicially authorized warrant, career agents, career prosecutors — the timing's got nothing to do with the midterms, the warrant just happens to land sixty days out, that's — did I say happens, I mean these things take the time they take, you can't rush a twenty-six-year-old filing. Well, you can. We just didn't, until now.”
