The Supreme Court cleared the way Thursday for New Hampshire to fully ban the use of student IDs for voting during the midterm elections.

The Supreme Court found ninety days enough room to run a voter-purge database and twelve days too few to read a student ID.

As it ran on the front
Set the week on a table and it reconciles. Five items. Two are orders of the Court. Two are on file at the Federal Election Commission. The fifth is a plan reported in September. Nothing in the stack is concealed and nothing in it is unlawful. That is the part to say first, flat, before anything else, because it is what the stack is for.
Item one. On September 25th the Court, six to three, lifted a lower court's block and let the Department of Homeland Security run its SAVE database against state voter rolls through the appeal. Federal law otherwise keeps a program like that out of the final ninety days before an election. Ninety days is the quiet period. The Court looked at the ninety days and found room in them.…
…(cont) Item two. On October 20th New Hampshire's Secretary of State asked the same Court to put a different block back up, the one on student IDs at the polls. On October 22nd the Court granted it. The rationale in the order is the risk of voter confusion from a rule change this close to a vote. Twelve days. Justice Ketanji Brown Jackson dissented, alone.
Run the two readings against each other, which is all I do here. Ninety days is enough time to match a federal database against a state voter roll while the case is still open. Twelve days is too tight for a poll worker to read a student ID. Same bench, same autumn, two clocks. The difference is not in the calendar.
Item three. The midterms' largest single donor has put in $366 million, $276 million of it since July. Independent expenditure is money spent for a candidate and never with one, which is the condition that makes the sum unlimited and the spender untouchable by the coordination rules. The terms were published that Wednesday: "live by the sword, die by the sword," and those who pick a fight should understand he will come for them, "not just their puppets." The sum is attached to a man. It is not attached to a name on the spending itself.
Item four. On Saturday The Lever traced millions from AIPAC arriving through committees branded around women, reproductive rights, Latino candidates. It is all on file. What the law asks of the line at the foot of an advertisement is the committee that spent the money, never the interest that wanted it spent, and a committee may be called anything at all. So the midterm money of the biggest spender in the field is filed under the name of women's health, correctly.
Item five. In September, NBC News reported that Elon Musk planned to spend at least $100 million to help Republicans this cycle, and critics asked why Democrats were not doing more to highlight it.
Line the five up and they point one way. The database runs; the student ID does not. Three hundred and sixty-six million dollars moves for candidates and never with them. AIPAC's money moves under a name about women's health. One hundred million is a plan, reported, answered with a question about messaging.
I am not naming a motive. I am naming a column. A gap of seventy-eight days in one direction, and nine figures of spending that the disclaimer is not built to describe, are the kind of gaps that keep turning up on one side of the ledger and not the other. No rule was broken, hon. The rules reconcile.
Nine days to November 3rd.
The receipts
The Supreme Court allowed New Hampshire to reject student IDs at the polls ahead of midterm elections, warning of voter confusion too close to an election.
The Supreme Court issued a ruling on Thursday, letting New Hampshire prohibit voters from using student identification cards to prove their identities before casting ballots in the midterm elections. The decision reverses a federal judge’s order blocking New Hampshire from enforcing a law that barred student IDs from being used for voter…
The U.S. Supreme Court temporarily greenlit a New Hampshire directive on Thursday that prohibits the use and acceptance of student IDs in elections. Justice Ketanji Brown Jackson was the lone dissent in the case.
A Lever investigation traces how the Israel lobby is routing millions through groups promoting women, reproductive rights, and Latino candidates — and how AI interests and other power brokers are adopting the strategy.
Justice Ketanji Brown Jackson publicly broke with her Supreme Court colleagues in a Thursday ruling allowing New Hampshire to fully block voters from using student IDs in the upcoming midterms. Jackson, the high court's most junior liberal justice, wrote in a short dissent that she would have left in place a lower court decision that...
