THE DECOY

Justice Department prepares to nullify Alaska's Senate race only if Republicans lose; Democrats spent months engineering that outcome.

As it ran on the front

I did the arithmetic at the Tesoro on Muldoon Road before I did anything else this morning: forty-six dollars and eighty cents to fill the tank, and twenty-six dollars short of what the fan belt costs at the parts store two blocks down, the one that's been singing on the turn by the post office since August. I mention the number because it sits still. Most of what came across the wire this week does not.

On October 14th, according to the Guardian, the president stood in front of Alaska voters and asked them to pick the "real" Dan Sullivan, because the ballot in November carries two candidates by that name — the sitting Republican senator, and a second filer, Dan J. Sullivan. A week later, on the 21st, the same paper had the other side of it: twenty-four Democratic attorneys general, meeting by Zoom and in what they're calling tabletop exercises, coordinating against what they describe as federal interference in the count. Then on the 24th the Justice Department went to federal court to ask a judge to block Alaska from certifying its Senate race. I have the number from that filing. It challenges zero ballots. Not one precinct, not one envelope. It only asks for the block if Senator Sullivan loses.…

…(cont) This morning the New York Times answered a question none of that explained, which is where the second Dan Sullivan came from in the first place. Operatives aligned with Mary Peltola, the Democratic nominee, spent months recruiting Dan J. Sullivan to file for the race, specifically to draw votes off the Republican column. Does it matter which came first, the recruiting or the suit? I keep turning that over and I don't think I've got it settled.

Here's what I can settle, or at least hold up to the light. I've got two ratchets on the pegboard in my garage that both take a 10 millimeter socket, because I bought the second one at the hardware store on Dowling after the first one walked off somewhere under the car, and I never did throw the old one out when it turned up again. They sit on the same nail now, close enough in the dark that I've grabbed the wrong one twice this month alone. If I sold tools instead of just fixing cars with them, and a customer came in wanting to buy the one that actually does the job, whose trouble is that supposed to be — the one reaching for the shelf, or the one who kept two on it?

That's the whole shelf, as far as I can tell. One party spent months stocking a second Dan Sullivan next to the first one. The other party is asking a court to decide, after the fact, whether the shelf was legal — but only if the senator is the one who loses.

Excuse me — before I let this go, one more thing, because it's been sitting in my pocket since the Tesoro this morning, next to the twenty-six dollars I didn't have. The Justice Department's filing has a condition built into it: it moves only if Senator Sullivan loses. Not if he wins. So whatever it is the filing is meant to protect — the count, the certification, whichever word you'd rather use — it's protecting one outcome out of two, and naming it in advance. Which outcome is that?

“Both sides are running the same card, a name on a ballot, and both of them timed it to land in the same ten days. The Justice Department isn't filing to protect an election, it's filing a backup plan that only pays out if their guy loses, and the only reason Democrats needed their own Dan Sullivan is because they know the courtroom, not the voters, might end up deciding this. Ten days out, and the thing picking your senator could be whichever trick finishes first.”
Sal
“Look, the Justice Department isn't "nullifying" anything, it's making sure Alaska's certification process is airtight, and you'd want that whether your guy wins or loses. We only asked the court to act if Senator Sullivan loses, which, I'll grant, is a strange thing to specify in advance if you actually believe the process is airtight regardless. Did I say that? Scratch that, next question.”
